Workplace Express features WWC SA’s Federal Court victory and its significance for workplace sexual harassment protections and employer accountability.
Workplace Express has featured the Working Women’s Centre SA’s historic Federal Court victory in Clarke v Beiler Constructions Pty Ltd as trustee for Fox Trading Trust [2026] FCA 734, the first fully contested judgment to consider the workplace sexual harassment protections introduced into the Fair Work Act in 2023.
The Court found that our client was subjected to workplace sexual harassment and held her employer vicariously liable, reinforcing that workers can be believed and employers can be held accountable.
As our CEO, Nikki Candy, told Workplace Express:
“This decision sends a powerful message to perpetrators that women will be believed, and perpetrators can be held to account even where the misconduct occurs in an isolated or private setting.”
