New employment law pathway to hear sexual harassment complaints

ABC Radio National’s The Law Report explores the first Federal Court decision on sexual harassment under new protections introduced to the Fair Work Act.

The case, Clarke v Beiler Constructions Pty Ltd [2026] FCA 734, is the first Federal Court decision under these new provisions, which followed recommendations from the 2020 Respect@Work report.

Working Women’s Centre SA Deputy CEO Anne Purdy joined presenter Damien Carrick, alongside Elisa Clarke, the litigant in the case, and Susan Price from the Working Women’s Centre ACT, to discuss the decision and how employment law can provide a new pathway for workers experiencing sexual harassment.
